This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our Services. By accessing or using the Services, you consent to the data practices described in this policy.

We collect information in two capacities: (1) directly from you as a User of our platform, and (2) information regarding third parties (Candidates or Entities) that you submit to us for verification or due diligence purposes.

2.1 Information Provided by You (User Account Data)

To create an account and use the Services, you may provide:

  • Identity Data: Name, email address, phone number, and job title.
  • Corporate Data: Company name, GSTIN, billing address, and corporate registration details.
  • Payment Data: Credit card details, bank account information, or UPI IDs (processed via secure third-party payment gateways).

2.2 Information Submitted for Processing (Candidate/Entity Data)

When you use our BGV, KYC, or Due Diligence tools, you may upload or input:

  • Personal Identifiers: Name, date of birth, father’s name.
  • Government IDs: PAN, Aadhaar number (subject to strict masking/redaction rules), Passport, Voter ID, or Driver’s License.
  • Background Data: Education history, employment history, address history, and references.

2.3 Information Collected Automatically

  • Usage Data: IP address, browser type, operating system, access times, and pages viewed.
  • Cookies: We use cookies to maintain your session and improve user experience.

3. How We Use Your Information

We use the collected data for the following specific purposes:

3.1 Service Provision

  • To verify the identity of Users and authorized signatories.
  • To conduct background checks, criminal record searches, and credit checks as requested by you.
  • To generate due diligence reports on individuals or corporate entities.

3.2 Legal and Regulatory Compliance

  • To comply with KYC (Know Your Customer) and AML (Anti-Money Laundering) regulations.
  • To maintain audit trails as required by law for background verification agencies.

3.3 Platform Improvement (AI & Analytics)

  • To analyze usage trends and improve our user interface.
  • Derived Data: We may use anonymized and aggregated data to train our machine learning models, improve accuracy in document parsing (e.g., OCR), and enhance our fraud detection algorithms. We never use personally identifiable Candidate data for these purposes in a way that can be reverse-engineered.

4. Processing of Public Records

A core component of the Services involves accessing and processing data from the public domain ("Public Records"), including but not limited to:

  • Court judgments and cause lists (e.g., eCourts, Supreme Court of India).
  • Ministry of Corporate Affairs (MCA) filings.
  • Police records and FIR data where publicly accessible.
  • Insolvency and Bankruptcy Board of India (IBBI) data.

Disclaimer: We collect this data strictly in accordance with applicable laws regarding public documents. We do not alter the original records but aggregate and organize them for ease of access.


5. Data Sharing and Disclosure

We do not sell your personal data. We disclose information only in the following circumstances:

  • Service Providers: We share data with trusted third-party vendors who assist in verification (e.g., field runners for physical address verification, university registrars, or NSDL/UIDAI gateways for ID validation).
  • Legal Requirements: We may disclose information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency).
  • Business Transfers: In connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

6. Data Storage and Security

6.1 Data Location All sensitive personal data is stored on secure servers located within India, in compliance with data localization norms for financial and payment data.

6.2 Security Measures We employ industry-standard security measures, including:

  • Encryption: Data is encrypted in transit (TLS 1.2+) and at rest (AES-256).
  • Access Control: Strict role-based access control (RBAC) ensures that only authorized employees can access sensitive data.
  • Aadhaar Security: We do not store raw Aadhaar numbers. Any Aadhaar-related processing is conducted in strict compliance with UIDAI regulations (using Aadhaar Vaults or reference keys where applicable).

6.3 Retention We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.


7. Your Rights

Depending on your role (User or Candidate), you have the following rights:

  • Access and Correction: You may request access to the personal data we hold about you and request corrections if it is inaccurate.
  • Withdrawal of Consent: You may withdraw consent for processing your data at any time. However, this may render us unable to provide the Services.
  • Grievance Redressal: You have the right to report privacy concerns to our Grievance Officer.

Note for Candidates: If you are a subject of a background check initiated by one of our Users (e.g., your employer), please contact that User directly for requests regarding your data. We act as a Data Processor on their behalf.


8. Cookies and Tracking

We use cookies to personalize content and analyze our traffic. You can choose to disable cookies through your browser settings, but this may affect the functionality of the Brivo platform.
